Egy angol földbérleti szerződés 1758-ból

This Indenture made the Twenty fifth day of March in the Thirty first year of the Reign of our Sovereign Lord George the second by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth and in the year of Lord One Thousand Seven Hundred and Fifty Eight BETWEEN the Most Noble John Duke and Earl of Bedford Marquess of Tawistork Lord Russel Baron Russel of Thornhaugh Baron Dowland (?) of Streatham Knight of the most Noble Order of the Garfor (?) and One of his Majestys most Honourable Privy Council (?) of the One part and Paul Tucker of Barnestaple in the Country of Devon Gentleman of the other part WITNESSETH that as well for and in Consideration of the Sume of Five Hundred Pounds of Lawfull Money of Great Britain to him the said Duke in hand well and truly paid by the said Paul Tuther at or before the Sealing and Delivery of these Presents as of the Yearly rent Servites (?) Covenants and Agreements hereinafter reserved expressed mentioned and contained on the part and behalf of the said Paul Tuther his Heirs Executors Administrators and Assignes to be paid done and performed HE the said Duke HATH granted bargained sold Aliened Enfeoffed (?) released and confirmed and by these Presents BOTH grant bargain Sossalison (?) enfeoff (?) release and confirm unto the said Paul Tucker his Heirs and Assignes in Feefarm Hee (?) that Hefsnagel (?) or Tenement (?) and Lands with the Appurtenames (?) commonly called or known by the Name of WEST WHITMORE otherwise BARTON GROUND (?) situate lying and being in the Parish of Bishops Tawton and is part and parcell (?) of the Manor of Bishops Tawton in the said Country of Devon and now in the Tenure or Occupation of the said Duke his Tenants or Undertenants containng in the whole According to a Survey made thereof in the Year One Thousand Seven Hundred and Fifty three Thirty four Acres Two Roods and four Perches or thereabouts as herein after Particularly mentioned (that is to say) The Stile (?) Close about Four Acres One Rood and Thirty Eight Perches the Meadow Close about Five Acres and Sixteen Perches The Barnfield Barn and Mow (?) Garden about Two Acres and Three Roods The Little South Field about Five Acres One Rood and Twenty Perches The Barn Close about One Acre Three Roods and three Perches the Great South Fields about Seven Acres the North Close about Five Acres Thirty Perches the Well Close and Lane about One Acre and Thirty Six Perches and the Thorne (?) Meadow or Thorner (?) Fields by Exeter Road about One Acre Two Roods and Twenty One Perches Together with all Edifries (?) Buildings Barns Stables Orchards Gardens Ways Paths Passages Waters Watercourses Ponds Soil Pools Easements (?) Profits Commodities Priviledges Advantages Appurtenances (?) whatsoever to the Premises herein before mentioned or any of them belonging or Appertaining or therewith or with any of them usually hold and Enjoyed as part or Parcell (?) thereof which said Premises are Particularly Delineated and described in a Plan or Map of the same hereunto Annexed And the Reversion and Reversions Remainder and Remainders rents Sones (?) and Profits of all and Singular the said Premises And all the Estate right Title Interest use trust Property claim and demand whatsoever of him the said Duke of into or out of the said Premises or any part or Parcell thereof(f?) (SAVING and always reserved to the said Duke his Heirs and Assignes and his and their Servants free liberty of Ingress Egress and Regress Way and Passage in through and by all usuall Way and Passages to and from his and their other Estates lying in the said Manor of Bishops Tawton And Also of Hawking Hunting Fishing and Fowling in and upon the said Premises at his and their Wills and Pleasures) TO HAVE AND TO HOLD the said Messuage (?) Tenement Lands Closes Meadows And all and Singular other the Premises herein before mentioned to be hereby granted enfeoffed (?) and released with their and every of their Appurtenames (?) (Except before Excepted) unto the said Paul Tucker his Heirs and Assignes TO the only proper use and behoofe (?) of the said Paul Tucker his Heirs and Assignes for ever YIELDING AN PAYING therefore yearly and every year for ever hereafter unto the said Duke his Heirs and Assignes at or in Porch of the Parish Church of Bishops Tawton afore said the yearly rent or Sume of One Pound One Shilling and Two Pence of Lawfull Money of Great Britain free and clear of and other Taxes whatsoever imposed or charged or which shall or may hereafter be imposed or charged by Authority of Parliament or otherwise howsoever by four even and equall quarterly Payments (to noit) (?) on the Feast of the Nativity of Saint John the Baptist Saint Michael the Archangel the Birth of Our Lord Christ and the Annunciation of the blessed Virgin Mary the first payment thereof to be made on the Feast of the Nativity of Saint John the Baptist now next Ensueing (?) the date of those Presents According to the New Stile or Computation of time and all other the Succeeding quartely Payments from time to time regularly to Succeed each other and to be paid Accordingly (anything in an Act of Parliament made and Passed in the Twenty fourth year of his present Majestys Reign) ENTITLED an Act for regulating the Commentement (?) of the Year and correcting the Calendar then (?) in use contained to the contrary Notwithstanding AND ALSO Yielding Paying doing and Performing for and in respect of the Premises Suit (?) and Servire (?) at and unto all and every the Courts of the said Duke his Heirs and Assignes to be hold and kept for and within the said Manor of Bishops Tawton upon such reasonable Notice and Warning as hath here (?) to fore (?) in like Cases been usually or Customarily given AND the said Paul Tucker doth hereby for himself his Heirs and Assignes and for every of them Covenant Promise grant and Agree to and with the said Duke his Heirs and Assignes that he the said Paul Tucker his Heirs and Assignes or some or One of them shall and will from time to time and at all times for over hereafter well and truly pay or cause to be paid unto the said Duke his Heirs and Assignes the afore said yearly rent or Sume of the One Pound One Shilling and Two Pence of lawfull Money of great Britain at or upon the days times and place and in such manner and proportions as are herein before mentioned and Appointed for payment hereof AND that if the said yearly rent of One Pound One Shilling and Two Pence or any part thereof shall happen to be behind or unpaid after any of the days and times where on (?) the same is hereby before reserved and made payable and Ought to be paid as afore said THEN and as often as the Case shall so happen It (?) shall and may be lawfull to and for the said Duke his Heirs and Assignes to enter and came into and upon the said Premises or any part thereof and thereto (?)
